Additional protection for your clinical staff

Whilst State-backed indemnity (CNSGP) will protect NHS work undertaken in respect of clinical negligence, the scope is very basic. Don’t assume it is a ‘cover-all’ solution – you could be exposed.

Here’s how you can get properly protected…

Limitations of State-backed indemnity cover

Whether working in a practice, PCN or GP Federation, State-backed indemnity will not cover any private work or anything in relation to Fitness to Practice investigations, regulatory matters such as GMC disputes, or the cost of coroner’s inquests and Good Samaritan acts, for example.

These shortfalls may leave your team exposed, should a claim be made against them for any of the above, including private or past works you’ve carried out.

MIAB’s wrap around cover, Indemnity Essentials,  is a comprehensive policy that fits neatly around the State-backed indemnity scheme, plugging the gaps in cover around day to day primary care work, and can extend to provide cover for any private works undertaken where necessary.

This additional protection is for anyone who is registered with a regulatory body who may not have cover in place or may be paying high costs for cover with a Medical Defence Organisation (MDO).

Typically, defence organisation cover is offered on a discretionary basis. This means that claims are settled at the discretion of the provider, rather than against a policy wording. Unlike MDOs, MIAB’s cover is insurance-backed, enforceable by law, underwritten by expert insurers and supported by an FCA backed policy wording.

Unique features of Indemnity Essentials cover include:

  • Group discounts and cover for multiple employers

If your GPs apply as a group for the Legal and Malpractice essentials pack, they can realise up to 20% discount over our already competitive premiums. Equally if members work for many employers and not just your practice, (federation, private practice, NHS partnership) our cover will extend to all activities upon request.

  • Revalidation

GPs may be required to prove their competency to allow them to continue to practice. In the event the Revalidation Board request retraining, our insurers will cover the associated costs of this up to £1000.

  • Indemnity to principal

Compensation claims for private work can be aimed at the GP or more commonly, they will target the practice trading name in the  legal action. In such cases, the practice will need their own cover to defend themselves alongside the insured GP. To mitigate this, our insurers will extend the cover back to the employer if the claim relates to an insured member.

  • 24-hour assistance

With 24/7 consumer legal advice, 24 hour medico-legal support and a counselling advice line.

Note that policy terms will apply.

MIABs’ Indemnity Essentials is made up of two parts:

Legal Essentials – which is the basic cover that everyone should have.

Malpractice Essentials – for those who require indemnity for private work.

As part of Direct Enhanced Services (DES) contracts, many PCNs & Practices take advantage of the Additional Roles Reimbursement Scheme (ARRS). This means there may be additional cover needed.
